If you are involved in a dispute with someone in one of these areas, if you both now agree to arbitrate instead of going to Court (of if you previously agreed to waive Court and arbitrate any disputes by including Our Clause in your business’s proposal or contract form), then RSC can preside over, hear the testimony, & decide your case with a binding Award:

01 — Real Estate Binder Deposit Fights

Buyer & Sellers to a real estate contract cannot agree on who gets the Binder Deposit (earnest money) when the transaction does not close.

02 — Breach of Contract

A claim that a party to a contract, service agreement, purchase agreement, vendor contract, materials supplier contract, or credit application breached or failed to perform the agreement.

03 — Breach of Vacation Rental Contract

A party claims that another party breached a Vacation Rental Contract.

04 — Commercial Disputes

Any of a variety of claims by one company against another company of a commercial nature.

05 — Specific Performance

A party seeks an Award confirming that the other party to a contract (e.g., seeking to force a seller to close on a real estate contract) must specifically perform the contract..

06 — Breach of Lease

A claim that a lease was breached by a party to the lease.

07 — Tortious Interference

A party claims that a party tortiously (wrongfully) interfered with the Claimant’s contract (or prospective business advantage) with another person or company.

08 — Civil Fraud

A party claims that another party made false (fraudulent) statements to induce the Claimant to make an adverse decision, which results in loss or economic injury.

09 — Civil Theft (Florida specific)

A party claims that someone stole property or money and seeks money damages equal to triple the value of what was stolen.

10 — Breach of Promissory Note

Claims that a party breached a Promissory Note.

11 — Breach of Mortgage & Foreclosure

Claims that a party breached a Mortgage & seeking a foreclosure remedy.

12 — Construction Lien Enforcement (Florida specific)

Claims seeking to foreclose a Construction Lien against real estate in Florida.

13 — Seller of Residential Real Estate’s Failure to Disclose Material Problem with Property (Florida specific)

Claims that a seller of residential real estate in Florida failed to disclose to a buyer material problems with the property.

14 — Breach of Non-Disclosure / Confidentiality

Claims that a party breached a Non-Disclosure or Confidentiality Agreement.

15 — Breach of Non-Compete

Claims that a party breached a Covenant Not-to-Compete.

16 — Breach of Non-Solcitation

Claims that a party breached a Covenant Not-to-Solicit customers or employees.

17 — Trespass to Land

Claims that a party trespassed to land owned by another.

18 — Conversion

Claims that a person destroyed or intentionally discarded personal property owned by claimant.

19 — Easement Disputes

Disputes involving easements.

20 — Condominium Association Disputes

Claims involving a Condominium unit owner and the Condo Association.

21 — Homeowners’ Association Disputes

Claims involving an HOA lot owner and the Association.

22 — Replevin

A party claims that another party took something belonging to the claimant and the claimant wants the item or property to be physically returned.

23 — Unjust Enrichment

Although a contract may not have been reached, a Claimant claims that it did something or gave something of value to another party and that the Claimant should be entitled to fair compensation, lest the other party be unjustly enriched under the circumstances.

24 — Account Stated

A party claims it is owned money for goods or services provided on account but not paid for.

25 — Deceptive & Unfair Trade Practice

A Claimant (whether a consumer or a business) claims that a business engaged in a deceptive or unfair trade practice.

26 — Injunctive Relief

Claims for temporary and permanent injunctive relief to prevent a person from doing something (prohibitory injunctive relief) or requiring a person to do something (mandatory injunctive relief), when supported by the facts and equity.

27 — Declaratory Relief

Where an actual, present, bona fide disagreement exists between two or more persons as to their respective rights or duties under some instrument or contract.

28 — Breach of Warranty

A party claims that another party breached an express or implied Warranty .
